Terms of Service

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract. Candidates must be based in the Philippines and eligible to work remotely for employers outside the Philippines. Employers must be authorized to hire independent contractors or employees, as applicable, in their jurisdiction. You may not use the Services if you are barred from receiving services under the laws of the United States, the Philippines, or any other applicable jurisdiction.

2. Services

ProvenRemote provides a two-sided marketplace:

• For candidates: A certification and matching program that includes application screening, voice auditions, AI-assisted training, and introduction to employer job posts.
• For employers: Tools to post roles, receive an AI-generated shortlist of certified candidates, send audio screening questions, review answers, and manage hiring workflows.

We do not employ candidates directly and we are not a party to any employment or contractor agreement between an employer and a candidate. We help make the introduction; the actual hiring relationship is between the employer and the candidate.

3. Candidate accounts and applications

To apply, you must create an account and provide accurate, complete information. This includes your full name, city in the Philippines, availability, time zones you can cover, English self-rating, internet speed, equipment status, expected monthly salary, and written answers to our screening questions. We may use automated and manual review to score applications and decide whether to invite you to audition.

By applying, you consent to AI-assisted screening of your written and audio responses, and you agree that our certification decision is final and made at our discretion. Certification is not a guarantee of placement, employment, or income. We may revoke certification if we discover misrepresentation, poor performance, or conduct that harms employers or the platform.

4. Voice auditions, recordings, and AI review

Auditions require you to record short audio clips using your browser. You grant ProvenRemote a non-exclusive, royalty-free, worldwide license to store, transcribe, score, and share these recordings with prospective employers in connection with matching. You may re-record each audition clip once. Audio submitted to the platform must be your own voice, unaltered, and recorded in a quiet environment.

AI is used to generate transcripts, score clarity, pace, confidence, script adherence, and objection handling. These scores are advisory; final admission decisions may include human review.

5. Training and roleplay

Invited candidates may complete training modules, a quiz, and AI roleplay scenarios. To become "Certified — AI Operator", you must pass the required thresholds (currently 8 out of 10 on the quiz and an average roleplay score of 7 or higher across 3 roleplays). Requirements may change from time to time. We may update training content, videos, and quiz questions at any time.

6. Employer accounts and job posts

Employers must provide accurate company and contact information to publish a job post. You may not post jobs that are illegal, fraudulent, discriminatory, or that misrepresent the role, pay, hours, or location requirements. Job posts are published at our discretion and we may remove any post that violates these Terms or that we believe is harmful to candidates or the platform.

Each published post receives a unique management link. Keep it confidential. Anyone with the link can view the post and shortlist until you close or delete it. You are responsible for any use of the link that results from your sharing it.

7. Fees and billing

Posting a job is free. Employer subscription plans are billed at the rates shown on the pricing page: currently $59 for the first month of the Standard plan, then $69 per month; Premium is $99 per month. Done-for-you placement and managed services are billed at $399 per placement and $300 per month respectively unless otherwise agreed in writing. All fees are non-refundable except where required by law or as explicitly stated on the pricing page.

Candidates are never charged to apply, audition, train, or be matched. If anyone asks you to pay for these services in the name of ProvenRemote, report it to us immediately.

8. Confidentiality and candidate data

Employers may receive candidate profiles, audio answers, transcripts, and scorecards. This information is confidential and may be used solely for the purpose of evaluating and hiring candidates for your posted role. You may not copy, sell, redistribute, or use candidate data for any other purpose, including marketing, surveillance, or building a separate database.

Public candidate cards and bench previews mask identifying details (such as full names) until you subscribe or otherwise unlock full access. Do not attempt to de-anonymize or identify candidates outside of the platform workflow.

9. Acceptable use

You agree not to:

• Provide false, misleading, or impersonated information.
• Harass, threaten, or discriminate against any user or our staff.
• Attempt to bypass platform security, access data you are not authorized to view, or scrape the site.
• Upload viruses, malware, or other harmful code.
• Use the Services for illegal activity or to solicit illegal work.
• Share login credentials or management links with unauthorized third parties.

Violations may result in suspension, termination of your account, revocation of certification, removal of job posts, and legal action where appropriate.

10. Termination

You may stop using the Services or delete your account at any time by contacting us at support@provenremote.com. We may suspend or terminate your account, with or without notice, if we believe you have violated these Terms, pose a risk to the platform or users, or for any other reason at our discretion. Upon termination, your right to use the Services ends immediately, but provisions related to confidentiality, intellectual property, disclaimers, and liability survive.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee that every candidate will be hired, that every employer will fill a role, or that AI-generated scores perfectly reflect a person's abilities. We are not responsible for the conduct, quality, legality, or suitability of any employer, candidate, or third party.

12. Limitation of liability

To the maximum extent permitted by law, ProvenRemote and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Services. Our total liability for any claim arising from the Services will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100.

13. Indemnification

You agree to indemnify and hold harmless ProvenRemote, its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your content, your violation of these Terms, or your hiring or contracting relationship with any candidate or employer.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Services will be resolved exclusively in the state or federal courts located in Delaware. You consent to the jurisdiction of those courts. Before filing a formal legal claim, you agree to contact us at legal@provenremote.com and attempt to resolve the dispute informally for at least 30 days.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms. If you do not agree, stop using the Services and delete your account.
